1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and O.P. Technologies ("JamSpot", "we", "us", or "our") governing your access to and use of the JamSpot mobile application and related services (collectively, the "Service").
By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
The Service is currently offered to users in Serbia and Hungary.
2. Eligibility
You must be at least 16 years old to use the Service. By using JamSpot, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization or business, you represent that you are authorized to bind that entity to these Terms.
3. Your Account
Registration. You can create an account using an email address and password, or through Google Sign-In or Apple Sign-In. You agree to provide accurate, current, and complete information and to keep it up to date.
Account security. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at support@jamspot.events if you suspect unauthorized use. We are not liable for losses resulting from unauthorized use of your account.
One person, one account. You may not share your account or create accounts through unauthorized or automated means.
4. The Service
JamSpot is an events platform that allows:
- Users to discover, search, save (favorite), and follow events and organizers, view event details and locations, add events to their device calendar, and share events;
- Organizers to create organizer profiles, publish and manage events, invite team members, and view aggregated performance statistics about their events.
We may add, change, or remove features at any time. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.
5. User Content
Your content. "User Content" means anything you submit to the Service, including event titles and descriptions, images, promotional documents, organizer details, addresses, links, and other materials.
Ownership. You retain ownership of your User Content.
License to us. By submitting User Content, you grant JamSpot a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g., resize images), translate, publish, publicly display, and distribute that content for the purpose of operating, promoting, and improving the Service. This license ends when you delete the relevant content or your account, except for content that has already been shared with others or that we must retain to comply with law.
Your responsibilities. You represent and warrant that:
- You own or have the necessary rights to all User Content you submit, including any images and the rights of any individuals appearing in them;
- Your User Content, and our use of it as permitted here, does not infringe any third party's intellectual property, privacy, or other rights, and does not violate any law;
- Information about events you publish (dates, locations, pricing, ticketing, and other details) is accurate and not misleading.
Public content. Events you publish and your organizer profile are publicly visible and may be shared by us and other users. Do not include confidential or private information in content you intend to keep private.
6. Acceptable Use
You agree not to:
- Post content that is unlawful, fraudulent, defamatory, obscene, hateful, harassing, or that infringes others' rights;
- Create fake, misleading, or spam events, or impersonate any person or organization;
- Promote events involving illegal activity, or content unsuitable for a general audience where prohibited;
- Upload viruses, malware, or harmful code;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Scrape, harvest, or collect data from the Service through automated means without our permission;
- Interfere with or disrupt the integrity or performance of the Service;
- Misuse the team-invitation feature, or invite people without a legitimate basis;
- Use the Service to violate any applicable law or regulation.
We may remove content or suspend or terminate accounts that violate these Terms, at our discretion.
7. Organizers and Events
If you create events or an organization profile, you are solely responsible for:
- The accuracy and lawfulness of your event information and organizer details;
- Honoring the events, offers, reservations, and any commitments you advertise;
- Compliance with all laws applicable to your events, including consumer-protection, ticketing, tax, safety, and licensing requirements.
Ticketing and third-party links. JamSpot does not sell tickets or process event payments. Where an event includes external ticketing, reservation, or payment links, those transactions occur with third parties and are governed by their terms and policies. JamSpot is not a party to and is not responsible for any transaction, reservation, or interaction between users and organizers, or between users and third-party providers.
Team members. Organizers may invite others to collaborate and assign them roles. The organization owner is responsible for managing team access and for the actions of their team members within the organization.
8. Subscriptions and Paid Features
The Service may offer a free tier and a paid PRO tier for organizers with additional features. Where paid plans are offered:
- Pricing, billing cycles, and included features will be presented to you before purchase;
- Payments are processed by the applicable app store or payment provider, subject to their terms;
- Unless stated otherwise or required by law, fees are non-refundable, and subscriptions may renew automatically until cancelled;
- You can manage or cancel subscriptions through your app store account.
We may change features, pricing, or the availability of plans on a prospective basis, with notice where required by law.
9. Intellectual Property
The Service itself - including its software, design, logos, trademarks, and content we provide (excluding User Content) - is owned by JamSpot or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service except as permitted by law.
10. Third-Party Services
The Service relies on and integrates third-party services, including Supabase, Google Firebase, Google Maps and Places, Google Sign-In, and Apple Sign-In, as well as external links added by organizers. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content and do not endorse them.
11. Notifications
With your permission, we may send push notifications related to the Service. You can disable notifications at any time in your device settings. We may also send service-related communications (such as account, security, or invitation messages) that are necessary to operate the Service.
12. Termination
By you. You may stop using the Service at any time and delete your account in the App (Settings → account deletion). Deleting your account removes your data as described in our Privacy Policy. If you are the sole owner of an organization with other members, you may need to transfer ownership before deletion completes.
By us. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination - including content licenses already granted, intellectual property, disclaimers, limitation of liability, and indemnification - will survive.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT EVENT INFORMATION POSTED BY ORGANIZERS IS ACCURATE, COMPLETE, OR RELIABLE. YOUR USE OF THE SERVICE AND RELIANCE ON ANY CONTENT IS AT YOUR OWN RISK.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAMSPOT AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) EUR 50.
This section does not limit liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, fraud, or willful misconduct.
15. Indemnification
You agree to indemnify and hold harmless JamSpot and its officers, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your events, or your violation of these Terms or any law or third-party right.
16. Changes to the Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Changes take effect when posted. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
17. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-laws rules. The courts located in Subotica, Serbia will have exclusive jurisdiction over any dispute, except where mandatory law grants you the right to bring proceedings in your country of residence. Nothing in this section deprives consumers of the protection of mandatory provisions of the law of their place of residence.
18. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
- No waiver. Our failure to enforce any right is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
